The first step to combat your involuntary dosing with estrogens is simply to eat more ?crucifers?. Crucifers are a group of vegetables including broccoli, Brussels?s sprouts, cauliflower and cabbage.

When you eat a vegetable like broccoli, your body breaks down the broccoli?s glucobrassicin into a compound called indole-3-carbinol (I3C). I3C plays an active role in flushing your body of cancer-causing chemicals. I3C is naturally broken down in your digestive tract to DIM (diindolylmethane). DIM is a key to prevent estrogen-generated cancers in men and women.

DIM clears rogue steroids into your urine. These steroids cause cancers to grow in both men and women. Breast, cervical, and prostate cancers all fit this scenario. We have known that these cancer cells grow slower in the presence of DIM for several years. Many animal and human studies have focused on breast, uterine, and cervical cancer. All have had positive results. Cancer cell growth slows down when introduced to DIM.

But the most impressive result is from a recent Journal of Biological Chemistry. University of California, Berkeley researchers discovered that when DIM was administered to prostate cancer cells, they stopped growing. And the cancer cells were reduced by 70%.

Black boxes, plane documents examined in Russian airline crash that killed 5

MOSCOW - Investigators on Sunday examined flight recorders and other evidence to try to determine the cause of the airliner crash in Moscow that killed five people, an official said.

The Tu-204 belonging to Russian airline Red Wings was carrying eight people, all of them crew members, when it careered off the runway Saturday while landing at Moscow's Vnukovo Airport. It went partly into an adjacent highway, broke into pieces and caught fire.

Four people were pronounced dead soon after the crash and the airline said on its Twitter account that a fifth, a flight attendant, died Sunday. Those who died Saturday were the pilot, co-pilot, flight engineer and another attendant, Red Wings said.

The survivors were reported in critical or serious condition in Moscow hospitals.

Vladimir Markin, a spokesman for Russia's main investigative agency, was quoted by Russian news agencies saying the data recorders were being examined, along with fuel samples. In addition, he said flight documents for the plane have been taken from the airline for examination.

Iran starts navy drills in Strait of Hormuz -IRNA

DUBAI (Reuters) - Iran started on Friday six days of naval drills in the Strait of Hormuz, the official IRNA news agency reported, maneuvers aimed at showcasing its military capabilities in what is a vital oil and gas shipping route.

Naval commander Habibollah Sayyari said the "Velayat 91" drills would last until Wednesday across an area of about 1 million square kilometers in the Strait of Hormuz, the Gulf of Oman and northern parts of the Indian Ocean, IRNA said.

Sayyari said the goal of the maneuvers were to show "the armed forces' military capabilities" in defending Iran's borders as well as sending a message of peace and friendship to neighboring countries.

Iranian officials have often said Iran could block the strait - through which 40 percent of the world's sea-borne oil exports pass - if it came under military attack over its disputed nuclear program.

Iran held a similar 10-day drill last December and sent a submarine and a destroyer into the Gulf four months ago just as U.S. and allied navies were conducting exercises in the same waters to practice keeping oil shipping lanes open.

Sayyari was quoted as saying on Tuesday that the new drill would test the navy's missile systems, combat ships, submarines and patrol and reconnaissance methods.

A heavy Western naval presence in the Gulf is meant to deter any attempt to block the waterway.

The?L.A. Daily News?reports the corps ripped up trees and stripped shrubbery from the Sepulveda Basin Wildlife Reserve ? an action they say was meant to help police an area known for homeless camps and lewd behavior.

They say the move was part of a multiyear restoration initiave that includes removing non-native plants and trees.?

San Fernando Audubon Society officials say the public wasn't throughly informed of the plan, and that?the "cleanup" removed native plants, utterly devastating an area that attracts many local and migratory birds.

Notes the?L.A. Daily News:

Where there had been three decades of coyote bushes, mulefat and elderberry tree growth, there were now stumps and a field of twisted branches.

Where there was once a smooth hiking path through an area called the South Reserve was now a mud-filled road scarred by thick tire tracks.

Where a forest of brush and tall trees stood in the center of the San Fernando Valley was now an unobstructed view of the Sepulveda Dam and the nearby Ventura (101) Freeway.

And where there were once warblers and least bell's vireos - not to forget the scissortail flycatchers, broadwing hawks and rose-breasted grossbeaks favored by birders across the state - there was hardly a bird in sight.

"It's going to be very tough for local wildlife,"?Muriel Kotin, one of four Audubon members to review the devastation, told the newspaper.

The society alerted Rep. Brad Sherman, whose office plans to talk with both sides.

A?61-page?vegetation management plan for part of the Sepulveda flood basin was published last August by the Army Corps but reportedly?wasn't shown to local environmental groups or Basin stakeholders.

The Audubon discovered the plan in early Dec. and expressed environmental concerns to the Corps.?A Corps spokesman said they would make "a better effort" in the future to notify residents and be aware of concerns.

"I am horrified and saddened, that no thought was given to the needs of wildlife that lived here," said Alan Pollackcq, an Audubon board member. "There was no (public) consultation."

Chris Matthews now the broadcaster that conservatives love to hate

NEW YORK, N.Y. - To his boss, Chris Matthews has become a statesman. His critics probably have other words.

The veteran MSNBC host raised his profile as much as any member of the television commentariat during the presidential campaign. His 5 p.m. "Hardball" show has seen viewership jump by 24 per cent this year from 2011, 17 per cent for the rerun two hours later.

Matthews symbolized MSNBC's growing comfort in being a liberal alternative to Fox News Channel. He engaged in an uncomfortable on-air confrontation with Republican National Committee Chairman Reince Priebus, seemed nearly apoplectic when President Barack Obama flubbed his first debate and had to apologize for appearing grateful that Hurricane Sandy might have helped Obama's re-election effort.

With Keith Olbermann out of sight, Matthews essentially replaced him as the commentator that most annoyed conservative viewers.

"During the run-up to the Iraq War, he just became really, really partisan and became even more so when MSNBC decided to become the anti-Fox," said Geoff Dickens, who used to watch Matthews as a fan and now monitors him regularly as part of his job with the conservative Media Research Center.

Matthews is not afraid to say what he thinks. He's a former newspaper columnist and one-time aide to a 1980s era Democrat, House Speaker Tip O'Neill. He seriously considered running for the U.S. Senate in Pennsylvania a few years back, where he probably would have been asked repeatedly to explain why he voted for George W. Bush in 2000.

He's a motor-mouth infused with a love of politics that borders on the pathological.

"He's as good as he's ever been," said Phil Griffin, MSNBC president. "He's at a place in his life where he's really comfortable in his own skin. He's a statesman. He has so much knowledge and I think he understands it better. He's always been great, but I really think he's been at the peak of his game."

Iraq turned Matthews against Bush. He said war and peace, and civil rights, are the issues that drive him most and explain his enthusiasm for Obama.

Matthews seemed personally offended by efforts in individual states to tighten voter registration and identification laws. Republicans called it an attempt to curb voter fraud; Matthews said it was to suppress voters friendly to Obama. He said Republicans would use welfare and other issues to subtly appeal to white voters still uncomfortable with a black president.

"The number of African-Americans who have come up to me in the last three to six months has been unbelievable," Matthews said in a recent interview. "They come up, six inches from my face, and say 'thank you.' A lot of the times they say we can't do this like you do it. It's harder for them because it sounds like complaining." He's disappointed that more whites didn't express gratitude, too.

His repeated attention to the issue "irritates some people, because they can't stand being called bigoted. It drives them crazy. And I agree, it would drive me crazy."

The issue drove his confrontation with Prebius, which occurred on "Morning Joe" during the GOP convention. Matthews challenged Prebius about playing the "race card" during the campaign and for references to Obama's birth certificate. It devolved into a schoolyard insult match.

"He should have kept it together in terms of tone," Griffin said. "But in what was said, going back and forth, it was a legitimate point."

Prebius later called Matthews "the biggest jerk in the room." Matthews doesn't seem to have any regrets.

"I'd been talking like that for awhile," he said. "He didn't like it. I didn't expect he would. I felt that I had in my presence the guy who represented the party and it was an opportunity I shouldn't let pass. It's one of those moments in the campaign that's going to have endurance."

The one quote Republican critics repeatedly throw back at Matthews is when he reacted to an Obama speech in 2008 by saying "I felt this thrill going up my leg."

Matthews points out that he said something similar in 2004, after Obama addressed the Democratic national convention. Its frequent citation annoys Matthews, who knows it will never leave him, but probably also because he thinks people miss the point. He was speaking more about what Obama represented ? a black man seeking the highest office in a land with a troubled racial history ? than Obama himself.

It hasn't exempted himself from some high-level teasing, like when Obama appeared at the campaign's Al Smith dinner after the president's disastrous first debate.

"I particularly want to apologize to Chris Matthews," Obama said. "Four years ago I gave him a thrill up his leg. This time around, I gave him a stroke."

Matthews said "Hardball" has gotten a sharper focus. The editorial opinion has moved to the front of the show. Saying what he thinks isn't hard; Matthews' flirtation with running for the Senate ended in part because the need to adhere to party orthodoxy wouldn't mix with a man comfortable with voicing a dozen opinions per minute.

"I never want to do what everybody else is doing," he said. "I don't want to be part of the chorus."

Like most in his trade, Matthews seems a little lost with the end of a long campaign. He's done a few speculative 2016 stories, not recognizing the subject is enough to send most people screaming from the room.

Every day is one day closer to another election, though.

"He is sort of the model figure for who we are," Griffin said. "He doesn't stick out loving politics and being passionate about politics. It comes across in everything we do ... And that's Chris."

Watchdog fines Wall Street firms $4.5 million for lobbyist payments

(Reuters) - Wall Street's watchdog has fined five large firms over $4.48 million for seeking reimbursement for payments to lobbyists using proceeds from municipal and state bond offerings.

The Financial Industry Regulatory Authority said on Thursday that it fined Citigroup Inc, Goldman Sachs Group Inc, JPMorgan Chase & Co, Bank of America Corp's Merrill Lynch and Morgan Stanley.

Wall Street's self-imposed watchdog said the banks unfairly sought reimbursement of fees they paid to the California Public Securities Association between January 2006 and December 2010 by requesting they be refunded as underwriting expenses from the bond sales.

FINRA said the firms "violated" fair dealing and supervisory rules of the Municipal Securities Rulemaking Board by seeking reimbursement for those payments to Cal PSA, a political association whose activities include lobbying on behalf of companies seeking to influence California state government.

"It was unfair for these underwriters to pass along the costs of their Cal PSA membership to the municipal and state bond taxpayers, neglecting to disclose that these costs were unrelated to the bond deals," FINRA's chief of enforcement, Brad Bennett, said in a statement.

The firms, which were fined more than $3.35 million and are required to pay $1.13 million in restitution to certain issuers in California, neither admitted nor denied the charges, but consented to the entry of FINRA's findings.

"We are pleased to resolve this matter and look forward to putting this behind us," Citi spokesman Scott Helfman said.

Morgan Stanley spokesman Mark Lake also said the firm is "pleased to have resolved this issue in a satisfactory manner for the firm."

Goldman Sachs said the company voluntarily refunded publicly disclosed Cal PSA fees in February 2011 for those charged as underwriting expenses on state-level issuances it lead underwrote, at the request of California's treasurer's office.

"At that time, we also discontinued the longstanding industry-wide practice of seeking reimbursement for such fees on offerings by state and local governments in California," said Goldman spokeswoman Tiffany Galvin. "We're pleased to have resolved this matter."

Merrill did not immediately comment on the sanction. JPMorgan declined to comment.

LAS VEGAS -- Police issued a new plea for information Thursday about a 10-year-old girl last seen with a card dealer just hours before the woman was accused of slashing a co-worker's face with razor blades at a Las Vegas Strip casino.

Police said Brenda Stokes told them she visited her doctor last week, seeking to be admitted to a hospital because she was "feeling like she wanted to hurt someone."?She is reported to have told investigators she hadn't taken her prescription anti-anxiety drug Friday, and that "Sometimes people just snap."?

A missing persons alert was issued late Tuesday about Jade Morris, 10, who officials say was last seen by her family about 5 p.m. last Friday with Stokes,?50, who also uses the name Brenda Wilson.

Police said Stokes was a friend of the girl's father and was supposed to have taken the girl Christmas shopping at an outlet mall off Interstate 15 near downtown Las Vegas.


Capt. Chris Jones, a supervisor in the Police Department's robbery-homicide division, said Stokes borrowed a red 2007 Saab sedan from another friend for the shopping trip but returned it.

A short time later, Stokes was arrested at the Bellagio casino, after being accused of attacking a female co-worker, Joyce Rhone, as the woman dealt blackjack.

Stokes is accused of wielding a razor blade in each hand as she attacked Rhone, who was hospitalized with deep cuts on her face, including one from her ear to the edge of her mouth. A police arrest report said Rhone, 44, also had several smaller cuts around her right eye.

Jade Morris' father interrupted an initial court appearance for Stokes, shouting,?"??You said you love me? Where's my baby at?" NBC station KSNV of Las Vegas reported.

Records show that Stokes was being held Thursday on $60,000 bail at the Clark County jail on felony battery with a weapon, burglary and mayhem charges that could get her decades in prison.

She told a judge Wednesday that she had not obtained a lawyer. She is due again in Las Vegas Justice Court on Friday.

The arrest report says casino video shows Stokes attacking Rhone before a casino patron and security officers intervene. Officer Marcus Martin said the video is evidence that may be shown by prosecutors in court but will not be made public by police.

Police said Stokes later told investigators that she attacked Rhone over harassing phone calls and an unspecified betrayal that ended their seven-year friendship.

Tejuana Reeves, Jade?s mother, told KSNV that she wanted to jump up and shake Stokes in the courtroom because she wouldn't say where the child was.

"From mother to mother, that feels so wrong," Reeves said. "I feel so betrayed because we trusted her with our child.?

FALLUJAH, Iraq (AP) ? Thousands of protesters demonstrated Sunday in Iraq's western Sunni heartland following the arrest of bodyguards assigned to the finance minister, briefly blocking the main highway linking Baghdad with neighboring Jordan and Syria.

The dispute threatens to exacerbate tensions with Iraq's Sunnis, who accuse Shiite Prime Minister Nouri al-Maliki of targeting and marginalizing them. The sectarian conflicts have largely paralyzed the government and have often turned violent.

On Friday, Iraq's Shiite-led government said it arrested 10 of Finance Minister Rafia al-Issawi's bodyguards on terrorism-related charges. The government said it carried out the arrests according to the law and opposes any efforts to sow sectarian discontent.

In al-Issawi's hometown of Fallujah, some demonstrators covering their faces with red-checkered traditional tribal headdress carried pistols under their clothes. Others held flags from the era of deposed dictator Saddam Hussein and those now being raised by Syrian anti-government rebels.

It was the second time in three days that protesters in Anbar province have flocked into the streets.

The protesters held banners denouncing what they called the "irresponsible practices" of the Shiite-led government against Sunnis and demanded the immediate release of al-Issawi's bodyguards. Other banners mocked that anti-terrorism law they charged applies only to Sunnis, while protesters chanted, "Down, Down al-Maliki."

Ali al-Moussawi, a spokesman for al-Maliki, said the demonstrations were aimed to create nationwide chaos and revive the sectarian conflict in the country.

"Raising the old Iraq flag means that there were people affiliated to the previous regime that cannot live in the new Iraq," al-Moussawi said. "The Iraqi government respects demonstrations and their demands if they are in line with the law, but such demonstrations where the old flag is raised and sectarian slogans are used aim only at creating chaos."

Demonstrators leveled harsh charges against the government.

"The injustice has reached its highest levels," said one demonstrator, who gave only his nickname, Abu Nouri, for security reasons. "Nouri al-Maliki is doing nothing for Iraqis," he said. "He's only busy removing political rivals from his path in the name of democracy and law."

"Why doesn't al-Maliki go after criminals and outlaws among the Shiites who sit in parliament and government, and are well-known for their atrocities over the years?" said another protester, who called himself Abu Omar al-Falluji, using a nickname for security reasons. "The answer is clear. He wants to shut the mouths that criticize him to turn this country into a pure Shiite one affiliated to Iran," he charged.

Fallujah, a former insurgent stronghold, is located 65 kilometers (40 miles) west of Baghdad.

The case of al-Issawi will likely fuel the simmering political infighting over power sharing in post-Saddam Iraq.

On Friday, Sunni Deputy Prime Minister Saleh al-Mutlaq threatened that his Iraqiya bloc could withdraw from the political process altogether if lawmakers and independent bodies are not allowed to monitor the investigation involving al-Issawi's staff.

The arrests came a year after the government arrested nearly 70 bodyguards assigned to Sunni Vice President Tariq al-Hashemi on terrorism-related charges. Then al-Hashemi himself was convicted of orchestrating death squads, a charge he dismissed as politically motivated.

Iraqi courts have since handed down multiple death sentences against him. He now lives in neighboring Turkey.

LAS VEGAS (AP) ? The last two times Boise State played in the Las Vegas Bowl, there were other places the Broncos wanted to be. Not so on Saturday, when the smallest player on the team came up big in a 28-26 victory over Washington.

After two straight blowouts in the Las Vegas Bowl, the Broncos had to work hard for a win sealed by a 27-yard field goal by 5-foot-5 Michael Frisina with 1:16 left. It left them feeling good about a game and a season when, unlike the last two years, there was hardly any talk about Boise State being in a BCS game.

"The most satisfying thing about this season was each week you'd see us get just a little bit better," Boise State coach Chris Petersen said. "These guys, they don't go through the motions. They have a chip on their shoulder."

The win capped another strong year for the No. 20 Broncos (11-2), who had to overcome a 205-yard rushing game by Bishop Sankey against their normally stingy defense. Sankey also had 74 yards receiving, giving him 279 of Washington's 447 yards from scrimmage.

But it was Frisina who came up with the biggest game of his career in his final game. He kicked three field goals, including the first game winner he could ever recall booting.

"It's every kicker's dream to win a big game with a field goal," Frisina said. "For this one to come on the last game of my career, you couldn't ask for anything more.'

Washington (7-6) had taken the lead for the first time on a 38-yard field goal by Travis Coons with 4:09 left when No. 20 Boise State got a big kickoff return by freshman Shane Williams-Rhodes to the Washington 42. Joe Southwick guided the team to the 12 before Frisina hit the winning kick.

"I was just focused on what I had to do," Frisina said. "I'm there as the insurance guy, I guess you'd say."

Boise State sealed the win when Jeremy Ioane intercepted Keith Price's pass as the Huskies neared midfield.

"To their credit they found a way to win the game in the end," said Washington coach Steve Sarkisian. "Our inability to finish is pretty blaring."

Sankey, who was third on the depth list when fall practice began, rushed 30 times and caught six passes in the biggest game of his career. He scored one touchdown and was the MVP of the game, despite being on the losing side.

"There's a lot of mixed emotions going on," Sankey said. "The MVP doesn't mean so much when you come out a loser."

Frisina was only 12 for 17 on field goals coming into the game, but kicked three of them, including a 34-yarder to open the scoring that was his first field goal over 30 yards for the year.

Southwick, meanwhile, had another efficient game, completing 26 of 38 passes for 264 yards and two touchdowns for a Boise State team that struggled offensively through much of the season before improving over its last three games.

"All year I knew I could play at this level," he said. "It's just a lot of work, a lot of moving parts to put the puzzle together. The last three games it's really showed. We've just been executing at a high level in the offense."

Southwick, a junior who took over from the departing Kellen Moore, also ran for 39 yards and had a punt that pinned Washington by its goal line in the fourth quarter.

Boise State, which outscored Utah and Arizona State 82-24 in its two previous Las Vegas Bowl wins, looked headed for a third straight blowout when Holden Huff scored on a 34-yard pass with 5:25 left in the second quarter for an 18-3 lead. But Sankey scored on a 26-yard run on Washington's next possession, and Price scrambled for another score with 3 seconds left to make it 18-17 at halftime.

The teams traded long drives in the third quarter, with Boise going 74 yards in 15 plays to open the second half, and Washington responding with a 75 yard, 12 play drive. The Huskies went for a 2-point conversion that would have tied it, but the pass was incomplete

Sankey kept Washington in the game almost by himself in the first half, scoring the first touchdown for the Huskies and gaining huge chunks of yardage against the normally stingy Bronco defense.

Of the 238 yards Washington gained in the half, Sankey had 178 of them. He ran 16 times for 130 yards and stretched out two short passes for another 48 yards.

Boise State was playing without starting defensive end Demarcus Lawrence, the team's sack leader. Lawrence was sent home Thursday for violating unspecified team rules, his second suspension of the season.

The two teams had met only once before, but they won't have to wait long to meet again. They will play in the opener of Washington's new stadium next August.

Five days after the tragic shooting at the Sandy Hook Elementary School in Newtown, Connecticut, President Obama said that he is committed to reducing the epidemic of gun violence that plagues this country every single day.

At a press conference in the James S. Brady Press Briefing Room?at the White House, the President announced that Vice President Joe Biden will lead a new initiative that has been tasked with identifying concrete proposals for real reform by January. The Vice President, who wrote the 1994 Crime Bill that helped law enforcement bring down the rate of violent crime and included the assault weapons ban, will work with members of the Cabinet and outside organizations on this effort, and President Obama urged the new Congress to hold votes on the proposals early next year:

The good news is there?s already a growing consensus for us to build from.? A majority of Americans support banning the sale of military-style assault weapons.? A majority of Americans support banning the sale of high-capacity ammunition clips.? A majority of Americans support laws requiring background checks before all gun purchases, so that criminals can?t take advantage of legal loopholes to buy a gun from somebody who won?t take the responsibility of doing a background check at all.?

Because the marks are identical, the first du Pont "heavily favors" a finding of likely confusion. Moreover, the greater the similarity between the marks, the lesser the degree of relatedness between the involved goods/services that is needed to support a Section 2(d) refusal. And with the marks identical, there only need be a "viable relationship" between the involved goods and services to support the refusal.

The PTO relied on seven third-party registrations for marks covering both insulating materials and consulting services. Under Albert Trostel, these marks suggest that the involved goods and services are of a kind that may emanate from a single source under the same mark. The examining attorney also provided third-party website evidence showing that insulation products used in construction are sometimes offered in conjunction with consulting services.

Atlas shrugged. It argued that this evidence fails to show that any entity, such as registrant, that manufactures metallurgical machinery and metallurgical plants also provides consulting services relating to insulation. Atlas contended that the identification in the registration is "relatively unclear," and so one must consider these services "in the larger context of registrant's business." Registrant's website suggests that its services should be "defined with respect to the metallurgical industry."

The Board disagreed that registrant's recitation of services, "consultancy in the fields of business construction and construction," was unusual or unclear, and therefore it concluded that resort to extrinsic evidence was unnecessary. Applicant, the Board observed, is improperly seeking to limit the scope of registrant's broad identification, rather than provide clarity. Of course, it is black letter law that the Board must consider the issue of likely confusion based on the recitation of services in the cited registration, regardless of the actual nature of the services, classes of consumers, or channels of trade.

The Board further noted that Atlas's goods and registrant's services are both related to the building construction industry. In fact, looking at some of the goods in the cited (multi-class) registration, it is possible that some forms of insulation could be used by registrant to mitigate excessive heat or loud noise associated with steel mills.

Finally, Atlas urged that the consumers of registrant's services are sophisticated in the metallurgical industry, but the Board (putting aside the fact that registrant's recited services are not limited to the metallurgical industry) pointed out once again that even sophisticated purchasers are not immune to source confusion, especially when identical marks are involved. Furthermore, there was no evidence that Atlas's customers are sophisticated, which raises the possibility of reverse confusion.

The Board concluded that there is a likelihood of confusion as to source or sponsorship, and so it affirmed the refusal.

It would have to show that such a restriction would result in the "avoidance of a likelihood of confusion." Judge denies Apple request to ban Samsung phones

(AP) ? A federal judge late Monday rejected Apple Inc.'s demands that its chief rival in the more than $100 billion global smartphone market cease selling models a jury recently found illegally used Apple technology.

The immediate impact of the ruling means that Samsung can continue to sell three of the older-generation smartphones still on U.S. shelves that a San Jose jury in August found ripped off technology Apple used to create its iPhone.

The jury ordered Samsung to pay Apple $1.05 billion after it found the South Korean titan "infringed" several of Apple's patents in creating 26 products ? three of which are still being sold in the United States.

U.S District Judge Lucy Koh noted that Samsung claims to have "worked around" using different technology than the Apple patents found to have been infringed such as the iPhone's popular "pinch to zoom" feature.

And even if that's a false claim, the judge ruled, Apple's demands to yank the Samsung products from U.S. shelves and bar future sales was too broad of a punishment in devices built with technology backed by hundreds of patents each.

"The phones at issue in this case contain a broad range of features, only a small fraction of which are covered by Apple's patents," Koh wrote in her ruling issued late Monday night. "Though Apple does have some interest in retaining certain features as exclusive to Apple, it does not follow that entire products must be forever banned from the market because they incorporate, among their myriad features, a few narrow protected functions."

The judge also concluded that the public would be harmed if she ordered a ban.

"Though the phones do contain infringing features, they contain a far greater number of non-infringing features to which consumers would no longer have access if this Court were to issue an injunction," the judge wrote. "The public interest does not support removing phones from the market when the infringing components constitute such limited parts of complex, multi-featured products."

At the same time, the judge also rejected Samsung's call for a new trial because of alleged juror misconduct.

Samsung had alleged jury foreman Velvin Hogan committed misconduct for failing to disclose that his former employer Seagate Technology filed a lawsuit against him in 1993. Samsung later acquired nearly 10 percent of Seagate.

Samsung alleged after the trial that Hogan had a bias against it because of its ownership stake in Seagate, a Northern California-based maker of computer hard drives.

The judge said Samsung had the ability to investigate whether Hogan was biased toward Samsung before trial started because the company's lawyer possessed Hogan's bankruptcy file, which included the lawsuit. She said Samsung objected too late to Hogan's joining the jury.

"What changed between Samsung's initial decision not to pursue questioning, or investigation of Mr. Hogan, and Samsung's later decision to investigate was simple: the jury found against Samsung, and made a very large damages award," the judge ruled.

Koh still has before her several other legal demands from both companies. Apple is seeking to increase the award while Samsung is asking for a decrease in damages ? or a new trial.

Samsung argues that it didn't receive a fair trial in San Jose, about 12 miles from Apple's Cupertino, Calif., headquarters.

Apple in turn argues that the jury didn't award it enough damages and is seeking more than $100 million above the $1.05 billion.

The judge earlier this month at a hearing seemed inclined to trim Apple's award by tens of millions of dollars after concluding the jury erred in its calculations, though she didn't specify an amount or a time she would rule.

Apple spokeswoman Kristin Huguet declined comment Monday night. Samsung officials didn't respond to email and phone queries placed late Monday night.

Adding to the legal tangle, Apple filed a second lawsuit earlier this year, alleging that Samsung's newer products are unfairly using Apple's technology. That's set for trial in 2014. In addition, the two companies are locked in legal battles in several other countries.

Apple lawyer Harold McElhinny claimed earlier this year that Samsung "willfully" made a business decision to copy Apple's iPad and iPhone, and he called the jury's $1.05 billion award a "slap in the wrist."

Samsung lawyer Charles Verhoeven has argued that Apple was trying to tie up Samsung in courts around the world rather than competing with it head-on.

Samsung recently shot passed Apple as the world's top smartphone maker.

In the third quarter of 2012, Samsung sold 55 million smartphones to Apple's 23.6 million sales worldwide, representing 32.5 percent of the market for Samsung compared with Apple's 14 percent.

COLUMBIA, S.C. (AP) ? To U.S. Rep. Tim Scott, keeping his modest upbringing in the front of his mind has helped guide his swift ascent in South Carolina's business and political circles and will continue to serve him in the U.S. Senate.

While race is certainly part of the man he has become, Scott hesitates to say it has anything to do with his status as a rising GOP star in a strongly conservative Southern state.

"What I've not ever really heard on the campaign trail was, besides the fact that you're black, or because you're black, here's what we want to do," Scott said Monday. "They've asked me questions about values and issues, and that's an amazing thing."

On Monday, Scott stood by as South Carolina Gov. Nikki Haley announced she had picked him to succeed Jim DeMint, who is departing the U.S. Senate in January to lead The Heritage Foundation. Scott will fill DeMint's seat for two years, then he could run in 2014 to finish out the remaining two.

Haley, the daughter of Indian-American immigrants and South Carolina's first female governor, said she chose Scott not to help diversify the GOP but because of his love for the state and ability to strongly advocate for it in Washington.

"I knew that he was the right person," Haley said. "It is very important to me, as a minority female, that Congressman Scott earned this seat."

Born in poverty in North Charleston, Scott grew up with a single mother who worked 16 hours a day to raise him and his brother. That mother stood to the side as Haley named her son as South Carolina's next U.S. senator. Scott described his mother as a loving but stern disciplinarian.

"I am very thankful to the good Lord, and to a strong mom who believed that sometimes love has to come at the end of a switch. And she loved me a lot," Scott said. "My mother did not quit on me."

As his mother struggled to sustain their family, Scott struggled in high school, flunking a handful of classes and working a movie theater job to help make ends meet.

Along the way, he was befriended by the late John Moniz, a conservative entrepreneur who ran a nearby Chick-fil-A restaurant. Scott often credits Moniz with being a mentor who taught him important values, such as how enlightened self-interest requires giving first before reaping a reward.

Scott earned a degree in political science from Charleston Southern University, which is affiliated with the South Carolina Baptist Convention and touts how it integrates faith into learning and serving. He ran a successful insurance business and for 13 years served on the Charleston County Council. He was also an honorary chairman for one of the re-election bids by the late political icon Sen. Strom Thurmond.

Scott became the only black Republican in South Carolina's Statehouse when he was elected in 2008. A year later, Scott announced he would run for lieutenant governor but quickly abandoned that bid when U.S. Rep. Henry Brown said he was retiring from Congress.

Scott was the contest's favorite after winning a nine-way Republican primary for the seat that had not elected a Democrat in 30 years, defeating Carroll Campbell III, the son of the late popular South Carolina governor. In a runoff, he also defeated Thurmond's son, Paul, with whom he'd served in county council. He won endorsements from tea party groups, including former GOP vice presidential candidate Sarah Palin and The Club for Growth, which promotes budget reform, free trade and reducing taxes.

After his election to Congress, Scott said his impoverished roots would play a role in his Capitol Hill career. During an interview with The Associated Press, Scott said conservatives needed to sell capitalism as a path from poverty and said he wanted to develop a plan for "people who come from neighborhoods like I came from and simply sell them on the fact that this country is a place where you can rise to any level."

On Monday, Charleston County Republican Party Chairwoman Lin Bennett said Scott was a strong, pro-business advocate who believes in a smaller government that leaves more decisions up to individuals. Bennett also downplayed any connection between Scott's race and his political successes.

"Obviously he's black, but I don't think that discussion has ever come up in selecting Tim to represent us at any level," Bennett said. "He knows what he believes in. People vote for him based on where he stands on the issues."

Petraeus mistress won't face cyberstalking charge

WASHINGTON (AP) ? The Justice Department has decided not to charge David Petraeus' mistress, Paula Broadwell, with cyberstalking as part of its investigation into an email scandal that led to the resignation of the CIA director and storied general.

Broadwell's lawyer, Robert Muse, gave The Associated Press a letter from U.S. Attorney Robert O'Neill that said no federal charges will be brought in Florida related to "alleged acts of cyberstalking."

Petraeus resigned as CIA director in November after acknowledging the extramarital affair, which was exposed after Broadwell emailed Tampa socialite Jill Kelley, allegedly warning Kelley to stay away from Petraeus and Gen. John Allen, the U.S. commander in Afghanistan.

Kelley reported the emails to the FBI, triggering an investigation that led the FBI to Kelley's emails to the married Allen, who is now under investigation by the Pentagon's inspector general.

"The decision on whether to bring a prosecution is always a serious matter, and one that should never be undertaken without the most thoughtful deliberation," said Justice Department spokesman William C. Daniels. "After applying relevant case law to the particular facts of this case, the United States Attorney's Office for the Middle District of Florida has decided not to pursue a federal case regarding the alleged acts of 'cyberstalking' involving Paula Broadwell."

A spokesman for Broadwell says she and her family are "pleased with this decision and pleased that this is resolved."

Her attorney has not been notified that she is the subject or target of any other Justice Department investigation.

Broadwell, Petraeus's biographer and a reserve Army officer, is still being investigated by the Pentagon for allegedly mishandling classified information. FBI investigators found a "substantial amount" of material marked classified at her home.

The documents were part of her research from her trips to interview Petraeus and his commanders across Afghanistan for her best-selling book on Petraeus, "All in," co-written with The Washington Post's Vernon Loeb and published by Penguin Press earlier this year.

Petraeus told friends that he had never given classified information to Broadwell, and she said she didn't receive such material from Petraeus.

Petreaus and Broadwell say their romantic relationship began only after he retired from the military and started at the CIA.

Both are married ? Petraeus, 60, to wife of 38 years, Holly Knowlton Petraeus, and Broadwell, 40, to husband Scott Broadwell. The Broadwells have two young children.

Petraeus and Broadwell have both expressed regret for the affair, which they say ended this summer.

The CIA is investigating Petraeus' conduct to examine whether he may have used CIA resources to further the affair, but the Pentagon has shown no appetite for recalling Petraeus to active duty in order to punish him for adultery, which is illegal under military law.

Married Tampa socialite Kelley befriended top military brass as part of her volunteer work hosting elaborate parties for Petraeus and other top commanders at Central Command, a huge military base in Tampa. That role expanded her influence in the Tampa business community and eventually won her role a post as an "honorary consul" to South Korea.

Kelley allegedly tried to exploit that honorary role to broker business deals between U.S. companies and the Korean government, a charge her lawyer denies. She has since been stripped of that post.

Florida Contemplates Its Online Options -- Including a Freestanding University

The board that governs Florida's public universities -- charged by the Legislature with weighing the state's options for expanding access through the use of online education -- weighed in on a consultant's report that suggested a range of possibilities, and kept open the prospect of creating a freestanding 13th university that would operate only online. At a meeting Monday, a strategic planning committee of the Florida Board of Governors heard a report from the Parthenon Group that suggested four possibilities, ranging from retaining the status quo (in which institutions would continue to provide their own offerings independently) to creating a separate institution. The Miami Herald reported that the board seemed to largely reject the status quo, and did not reject the idea of creating a new institution, despite opposition from the provosts of existing universities, who in a letter expressed concerns about dilution of resources and competition.

The idea that got the most support during the board's discussion, according to the Herald, was a hybrid of the consultant's other two recommendations, involving more systemwide collaboration or allowing one or more existing institutions to take the lead on creating new programs.

for the past couple of months, i been so forgetful plus my mind feel drained and in need of work out. it involves short-term memory and i forget what i was going to do. sometimes when i make food, i forget what i need to do. idk if its sign of depression because i experienced it off and on or my sleeping pattern contributing to it. i wake up at 11 am or 12 and go to bed at 2 am or 3 am. i get so distracted these days and i want my good memory back.
