Ticketmaster customers to get small fee credits

(AP) ? Concertgoers who purchased tickets through Ticketmaster are being notified that they'll soon receive credits for fees they were charged over the past decade.

Emails are being sent to customers who are entitled to the credits as part of a class-action lawsuit filed in 2003 that alleged the company overcharged them. A pair of men had sued in Los Angeles over fees they were charged for purchasing tickets to Wilco and Bruce Springsteen concerts.

A settlement, which received preliminary approval from a judge in October, will give customers a $1.50 credit on up to 17 tickets they purchased between specific dates in 1999 and 2011 that they can use on future purchases. It will also credit purchasers who received tickets via UPS up $5 for up to 17 transactions. The settlement is scheduled to be finalized in May.

The credits are for an "Order Processing Fee" that Ticketmaster assessed on purchases.

The credits come with several restrictions: Customers can only use two credits at a time and cannot use them for events scheduled at venues owned by concert giant AEG Live.

Customers who were charged the fees are receiving emails announcing the settlement and will receive messages after the settlement is finalized with details on how to redeem the credits. A website has also been established explaining the case and the settlement.

Matthew Cameron, a Massachusetts lawyer, is objecting to the settlement, claiming its credits are "virtually useless" and do not fully compensate customers.

He wrote in a statement to the judge handling the case that the credits have no cash value and are "plainly designed to directly profit defendants at the further expense of the class."

Cameron purchased 18 tickets between 2006 and 2010, according to his filing.

Ticketmaster is owned by Live Nation Inc. The company did not immediately return an email message seeking comment.

KINSHASA, Congo ? Preliminary results from Congo's presidential election show incumbent Joseph Kabila leading opposition leader Etienne Tshisekedi, although the country's election chief warned only a small percentage of precincts had been counted.

With around 15 percent of votes tallied, Kabila leads with over 1,52 million, around 52 percent, according to results announced Friday. Tshisekedi is second among the 11 candidates with 997,074, or 34 percent.

Election commission president Daniel Ngoy Mulunda released the early results four days after Monday's vote, after the Election Day was extended for three days to give porters time to transport ballots from the remote corners of this giant nation.

Compiling the results was chaotic. In the capital Kinshasa, sacks of ballots brought in on the backs of poll workers piled up on grass outside the counting center, many having split open. People trampled on the ballots which had spilled on the dirt path leading into the warehouse.

Mulunda released the first results after opposition candidate Vital Kamerhe called a press conference urging the commission to publish partial results for the sake of transparency.

Complicating procedures, fake results had been posted on the election commission's website, said Mulunda. Young Tshisekedi supporters also weaved between cars at downtown intersections, selling a $1 sheet showing a different set of provisional results which had their choice of president in the lead.

Congo remains on edge after days of violence which left at least 18 dead and seriously wounded 100 more, with most of the deaths caused by troops loyal to Kabila, Human Rights Watch said in Friday.

The violence peaked on Saturday when tens of thousands of people descended on Kinshasa's airport to welcome home Tshisekedi as he returned from his final campaign tour in the country's interior. In the government crackdown that followed, at least 14 people were killed, according to the report by the New York-based rights group.

Soldiers fired into the crowd, hitting a 27-year-old mother of five in the head. Among the other victims was a 22-year-old who was shot dead while walking outside a granary near the airport. On Election Day, mobs descended on poling stations. Poll workers were beaten, and vote centers were destroyed.

Government spokesman Lambert Mende denied the accusations in the report, saying the presidential guard shot in the air.

"We are in an African city. We are Africans. And nowhere ? not in (the neighborhood of) Masina, not in the mayor's office ? no one is aware of a wake, or of a funeral. No cemetery has registered a burial. Only HRW is aware of this," he said.

Analysts are concerned that there could be further bloodshed when the election results are announced, scheduled for next Tuesday.

The U.N. Security Council on Friday condemned the bloodshed and urged all candidates and their supporters to refrain from further violent acts.

Congo's enormous territory still includes sections of the bush that are controlled by rebel groups, like in the east where the brutal Lord's Resistance Army is known to be based.

In Oriental province near the town of Faradje, Human Rights Watch says the Lord's Resistance Army attacked a group of voters on their way to vote. Three men were killed, and ten women were abducted. The report says that one of the women, who was six months' pregnant, was raped. She was later released and taken to the hospital but lost her baby.

This is only the second free election in Congo's 51-year history, and the first to be organized entirely by the government instead of by the international community. The logistical challenges are casting a cloud of doubt over the vote, and three of the 11 candidates running for president have already called for the ballot to be annulled.

If a fat tax is coming, here's how to make it efficient, effective

A 'sin tax' applied to sweetened goods on store shelves is not the most efficient, effective method of lowering caloric intake from sweet food and would be more disruptive to consumers than necessary, according to Iowa State University research.

With a national debate taking shape about the possibility of a national tax on foods with high sweetener content, ISU economists have examined how such a tax would best be applied.

Rather than assessing a tax on these sugary goods as they are taken through the grocery store checkout lines, the research shows that a better way is to tax the food processers on the amount of caloric sweeteners, such as corn syrup and sugar added in processing before the product hits the shelves.

The economists, John Beghin and Helen Jensen, both professors in the Department of Economics, are quick to point out that they are not advocating for or against any tax, but simply researching how and where a possible sweetener tax would be most effective.

"We are not saying. 'To resolve obesity, here is what you should do,'" said Beghin. "In that sense, we are not advocating anything. We are saying, 'Given that you are considering a panoply of tax instruments, and there is a possibility of a soda tax, is there a better way to use that idea?'"

"This is motivated," added Jensen, "by a lot of ideas out there that say we could tax sweetened products. We wanted to see what the effect of such a tax would be and, alternatively, if you imposed a tax on ingredients, what would be the effect of that."

The research, published in the journal Contemporary Economic Policy, shows that if the goal of a sin tax on sweeteners is to reduce calories consumed, lawmakers should consider taxing the inputs instead of the final product.

Assessing the tax at the processing stage allows food processors to reduce the amount of sweeteners they put into their products. Processors will also have incentives to use more of the lesser-taxed artificial sweeteners, and less of the higher-taxed sweeteners that are heavy in sugary products.

These solutions would also raise the price at the store less than a direct tax on the end product, while reducing the calories attributable to the sweetener, according to the study.

"Taxing the processing ingredients makes more sense when compared with taxing the end product," said Beghin. "You can abate the same number of calories without having consumers face such high prices."

Any new tax on sweeteners, even the tax on food inputs proposed by the study, will cause prices to go up. One drawback of any tax on sweetened goods is the regressive nature of that tax.

In economic terms, regressive taxes are those that impact poorer economic groups more than higher ones.

"Since much of these (sweeter) goods are consumed by poorer economic groups," said Beghin, "you may be increasing the cost of calories for poor people."

The study looks only at calories in food. The research does not make any claims about lowering obesity.

The United States' obesity rate has many factors, and the amount of calories consumed is only one, say the economists.

"We are not looking at health aspects," said Jensen. "Just the consumption of calories from sweetened goods and the disruption to the consumer."

The findings of the study fit generally accepted economic principles that say if you want to change a given behavior or economic decision, you should try to find a policy instrument that is closest to the behavior or decision, according to Beghin.

As part of the study, the two collected data from both government and private sources on industrial food inputs.

"We spent quite a bit of time assembling a data set based on published data on what inputs the food industry uses," said Jensen. "So we know that for all the different food sectors, how much sugar and corn syrup go into that industry group's food processing. You'd be amazed to see how much sweetener goes into food processing."

Hours after being released by the Vikings, quarterback Donovan McNabb appeared on ESPN?s SportsCenter to discuss the situation with Jay Harris.

?I thought it was best suited for Christian [Ponder] as well as Joe [Webb] to get an opportunity to develop and mature in the offense which they?ve had and I just wanted to be the guy to try to add that confidence and sort of that spiritual advice to provide for those guys to better them,? McNabb said.? ?But I just thought the best move for me at this particular point was to move on and clear my thoughts and clear my head and see what?s next.?

So what?s next?? Asked to explain what a new team would be getting, McNabb rattled off his attributes.? ?You?re bringing a veteran who can bring experience to your ball club, athletic ability, a guy who is not a locker room cancer, he works hard ? great work ethic and only wants to win,? McNabb said.? ?And you know I?m a winner and I?ve proven that, and a guy who will make the players around him better.?

Of course, McNabb apparently was able to make the players around him only so much better.? ?I think we began to lose focus of this being a team game,? McNabb said.? ?The teams in which I?ve played with, you know, a lot of great athletes, a lot of positive things, but nothing to really show for it.? Obviously, the quarterback is the one who receives a lot of the credit, and as well as too much criticism.? Being the leader of the team, you just want to prepare your team each and every weekend, while you?re being prepared as well.? The teams with which I?ve played with, unfortunately we weren?t able to accomplish the things that we wanted to in the winning department, but? still individually each and every person can move on, including myself, and possibly have a better life somewhere else.?

So what will that better life entail for McNabb?? ?Being surrounded by a great supporting cast,? McNabb said.? ?When you?re surrounded by experienced players and veteran players who know how to win, then that?s something that?s contagious.? And I think there are a lot of teams who are in desperate need of a quarterback at this particular point who are surrounded by veteran players, and teams that play well together.? So for myself it?s really an opportunity for me to at this particular point clear my head, concentrate on the goal and the task at hand and get back to thinking and getting out on the field and playing the way that I know I?m capable of playing.?

There actually aren?t ?a lot? of teams who are in ?desperate need? of a quarterback and ?who are surrounded by veteran players.?? There are, as playoff contenders go, two.? The Bears and the Texans.? And the Texans reportedly aren?t interested.

So that leaves the Bears.

Regardless of the destination, McNabb sounds ready to play.? ?Taking time is very important, although I?ve spent enough time resting so to speak in this last couple weeks, so I am pretty fresh,? McNabb said.? ?But you know what the thing about it [is] you have to refocus your mind on being the guy back out there again, and I look forward to that.?

McNabb, who described his last two seasons as ?exciting? (which is sort of like calling a visit to a funeral home ?scintillating?), seems to acknowledge the possibility that no one will want him.

?There?s always Plan B, but one that I?m not focused on at this particular point,? McNabb said.? ?Clearing the mind and getting the body back where it needs to be is the most important thing.? But if anything was to happen, I have a career that I can look back on and be very excited about.?

Exciting, but ultimately unfulfilling.? But not just because of McNabb?s ability.? Because of his supporting cast.
