Hillary Clinton group raises $1 million

(AP) ? A group working to support Hillary Clinton's prospective presidential bid has raised more than $1 million.

An official with the Ready For Hillary super PAC confirmed Tuesday that the organization hit the million-dollar threshold since beginning to collect donations in earnest this spring. The total will be reported in the group's financial report on Wednesday.

Clinton, who resigned as secretary of state in February, has not announced whether she will seek the presidency in 2016. But the super PAC dedicated to her political future has attracted several prominent donors and campaign operatives in recent months.

Clinton is not formally connected to the group. She has been making public appearances and working on a book since leaving the State Department.

Brooks Forester breaks up with Desiree Hartsock, even though she admitted to being in love with him.

"Bachelorette" contestant Brooks Forester shocked Desiree Hartsock Monday night when he unexpectedly departed the show after admitting that he wasn't in love with her.

Hartsock, who had held a special place in her heart for the Salt Lake City marketing consultant from the very first night, was crushed. Before being dumped, she had admitted that her feelings for Forester were very strong.

"Brooks has always been a frontrunner, from day one," she declared during the episode. "I'm in love with Brooks and I miss him every day I'm not with him."

Forester, one of three remaining men who journeyed to the island of Antigua, told host Chris Harrison that he began to doubt his feelings for Hartsock during the show's hometown date week. And while he wanted to be in love with her, he didn't think he'd ever be at the point where he was ready to propose.

"I really want to be madly in love with you, you know?" he later told a crying Hartsock. "I don't feel it ... I don't feel like the moments apart are hard enough."

During the scene, a tearful Hartsock admitted to Forester that she was in love with him. It marks one of the first times in the show's history that a Bachelorette said "I love you" to a contestant before the final proposal.

The bad news came for Hartsock after she spent a great day (and a sexy night in the Fantasy Suite) in Antigua with each of the other two remaining men: Seattle mortgage broker Chris Siegfried and Drew Kenney, a digital marketing analyst from Scottsdale, Ariz.

?It breaks my heart knowing that I have two amazing, like, unreal guys who do want to love me," she said. "I just can?t love them as much as I know I have to give. ... Honestly, for me, it?s over.?

While both Siegfried and Kenney remain in the competition, previews for next week's finale episode reveal that they, as well as Hartsock, may go home alone.

Will Forester come back? Will Hartsock accept a proposal from one of the other guys, or will she leave brokenhearted? The second part of the season finale airs next Monday, Aug. 5 at 8 p.m. on ABC.

Beth Israel to pay $5M in claims flap

Beth Israel Deaconess Medical Center will pay more than $5 million to settle allegations that the teaching hospital made improper Medicare claims.

From mid-2004 to mid-2008, the U.S. Attorney?s Office said, the hospital improperly filed claims for inpatient admissions for patients who stayed overnight with congestive heart failure, chest pain and other ailments. The procedures should have been billed as observational services, which is an outpatient service, according to U.S. Attorney Carmen Ortiz?s office.

Medicare reimbursements to hospitals are significantly higher for inpatient admissions.

Under the agreement, the hospital does not admit any fault or wrongdoing but will pay $5.315 million to settle the allegations that it violated the False Claims Act.

?When hospitals unnecessarily admit Medicare patients for short inpatient stays when the appropriate treatment would be outpatient or observation care, they improperly boost hospital profits at significant expense to taxpayers and patients,? said Susan J. Waddell, special agent in charge of the Department of Health & Human Services, Office of Inspector General.

In a statement, the hospital called the distinction ?an extremely technical issue? that challenges hospitals around the country.

The hospital has already taken steps to address the issue, according to the statement, including enhancements to the billing classification system and creating a new position in charge of compliance.

?BIDMC is committed to delivering the appropriate level of care to patients in need and ensuring that the hospital is in full compliance with all applicable rules and regulations,? the statement said.

London Markets: FTSE 100 climbs as GKN, Weir, ITV rise

LONDON (MarketWatch) ? U.K.?s benchmark stock index climbed for a second straight day on Tuesday, as GKN PLC, Weir Group PLC and ITV PLC rose after well-received earnings reports, offsetting declines for Barclays PLC and BP PLC.

The FTSE 100 index /quotes/zigman/3173262 UK:UKX +0.27% ?gained 0.1% to 6,568.91.

Barclays raises billions in capital

Bowing to pressure from regulators, Barclays has announced plans to raise nearly ?5.8 billion in shares and ?2 billion in bonds to address a capital-ratio shortfall. News of the plans pushed the bank?s share price sharply lower.

Shares of GKN /quotes/zigman/287711 UK:GKN +6.66% ?jumped 5.6%, after the engineering group said it expects a stronger second-half performance driven by its Aerospace Engine Systems division. Additionally, first-half sales climbed 12%.

Another engineering firm, Weir Group /quotes/zigman/130249 UK:WEIR +3.56% ,?picked up 3.5%. The company delivered half-year results in line with its own expectations and said it remains on track to meet the full-year target.

Broadcaster ITV /quotes/zigman/337392 UK:ITV +4.71% ?rallied 5.3% after reporting a 15% rise in first-half adjusted earnings per share and saying the outlook looks positive for the rest of 2013.

Shares of Next PLC /quotes/zigman/312884 UK:NXT +2.10% ?put on 2.1% after the fashion retailer raised its pretax-profit guidance for the full year to a range of 635 million pounds ($937.9 million) to ?675 million, from its previous estimate of ?615 million to ?665 million.

Barclays shares drop on Tuesday after the bank announces plans to raise more capital.

On a more downbeat note in London, Barclays /quotes/zigman/301787 UK:BARC -7.28% ? /quotes/zigman/152323/quotes/nls/bcs BCS -3.15% ?slumped 4% after the U.K. bank said it plans to issue 5.8 billion pounds ($8.9 billion) in new shares to address a capital shortfall. Additionally, the bank pushed back its target for return on equity, saying it would exceed cost of equity in 2016 rather than in 2015.

Other banks were also lower, with Royal Bank of Scotland Group PLC /quotes/zigman/10330253 UK:RBS -2.15% ? /quotes/zigman/530544/quotes/nls/rbs RBS -1.67% ?down 2.2% and Lloyds Banking Group PLC /quotes/zigman/126322 UK:LLOY -1.57% ? /quotes/zigman/255656/quotes/nls/lyg LYG +0.24% ?off 1.8%.

Aberdeen Asset Management PLC /quotes/zigman/152853 UK:ADN -3.06% ?lost 4.5% after Morgan Stanley cut the investment firm to equal weight from overweight.

BP /quotes/zigman/210014 UK:BP -4.80% ? /quotes/zigman/247026/quotes/nls/bp BP -1.06% ?slid 3.7% after the oil giant said profit from operations slipped in the second quarter due to higher taxes and costs, and lower oil prices. Additionally, BP increased its estimate for the cost of a disputed claims-settlement process related to the 2010 Deepwater Horizon oil spill.

Oil prices were also lower on Tuesday.

SM West football star fights off attackers after Shrine Bowl

Brett Sterbach?s opponents learned not to underestimate the former Shawnee Mission West High School running back as he helped lead the Vikings to their first Kansas state football championship in 27 years.

Two would-be muggers at a Topeka gas station learned a similar lesson shortly before 11 p.m. Saturday. That?s when the 5-foot-7, 155-pound Sterbach, 18, wrestled away a knife, suffering a stab wound in his thigh, then fought off his assailants, forcing them to flee.

Sterbach was headed home from playing on the winning team in the Kansas Shrine Bowl, an all-star football game at Washburn University. His parents, Nick and Julie, and an uncle, Brad Earnest, who?d flown in from Connecticut to attend the game, were also in the car when it stopped at the Phillips 66 at Hudson Crossing, 810 SE 15th St.

?Brett didn?t want to go in,? Julie Sterbach said. ?He was tired, so I was getting him a drink and a snack for the long drive home. That?s when it all transpired.?

Brett?s dad and uncle also went into the store. Then two men approached and knocked on the window of Nick?s Honda Accord, where Brett was in the back seat talking on his cell phone to a friend.

?These two guys come up to my car and one knocked on the window to ask for something,? Brett said. ?I opened the door and, as soon as I did, they pulled a knife on me and said, ?Give me all your money.??

When Brett said he didn?t have any money, the robbers demanded his phone.

Brett chose to fight back.

?I hung up my phone and acted like I was going to put it in my pocket,? Brett said. ?He had the knife at my rib level, so I pushed it down because I didn?t want it near any vital organs. He pushed it forward at the same time, and that?s when I must have been stabbed in the leg, but I didn?t even feel it go in.?

Brett said he wrestled the knife away from his attacker as the second assailant struck him in the head. Then Brett said he stabbed the first attacker in the abdomen. Topeka Police confirmed surveillance video shows two men approaching the car and then an altercation outside of the car.

?I pushed the other guy off me and got out of the car and squared up to them,? Brett said.

The second attacker rushed Brett, who still had the knife in his hands.

?I thought I stabbed him once, but the cops who saw the surveillance video said, ?No, you stabbed him a good five times in the collarbone area,?? Brett said.

After that, the attackers, who face attempted aggravated robbery charges, fled. Brett gave chase before the first attacker appeared to pull something ? perhaps a gun ? from the pocket of his hooded sweatshirt.

Blood streaming down his leg, Brett then retreated inside the store to find his parents.

?Honestly, my first thought when he came inside was, ?Why is Brett holding that knife??? Julie said. ?It just didn?t make sense to me then I looked down and blood was everywhere dripping down his leg. That?s when I asked the (gas station attendant) to call 911.?

Brett ? a first-team All-Metro running back who racked up 2,228 yards and 22 touchdowns as a senior, including 273 yards against Hutchinson in the championship game ? was taken to a hospital. Stitches were required to close the two-inch deep, quarter-inch-long knife wound on the outside of his right thigh.

No arrest had been made as of Monday afternoon.

?We haven?t identified any suspects, but the information available on the video leads us to believe the investigation will proceed,? Topeka Police Capt. Scott Conklin said.

Conklin also said he was glad Brett?s situation worked out the way it did but cautioned others against taking such bold actions.

?When you take actions like that, you can be easily overwhelmed or fall, and now we?re talking about a tragedy,? he said. ?Most of the time, whether it?s a wallet or phone or whatever they are demanding, it?s not worth it.?

Sterbach, while proud he fought off his attackers, also realizes he was lucky to escape serious injury.

?I?m just glad nothing worse happened,? he said. ?During this whole Shrine Bowl experience, I got to see so many kids who were born with no limbs and other problems.

?I?m glad I got out with nothing major. It?s just a little stab wound, but it didn?t hit any bone or any major arteries. I could have been killed, so I?m blessed that?s how it ended up.?

Amanda Berry surprises Cleveland concert crowd

CLEVELAND (AP) ? One of three women held captive in a Cleveland home for a decade made her first public appearance at a concert featuring the rapper Nelly a day after her abductor pleaded guilty to kidnap and rape charges.

Amanda Berry showed up at the daylong RoverFest concert in Cleveland on Saturday night, walking on stage with her family and waving at the cheering crowd. Wearing sunglasses and dressed in jeans and a black T-shirt, Berry smiled broadly while acknowledging the applause, but she didn't address the crowd. Nelly called Berry back to the stage after his music set.

The appearance came a day after Ariel Castro, a former school bus driver, pleaded guilty to 937 counts in a deal that will send him to prison for life without parole, plus 1,000 years.

Berry, now 27, Gina DeJesus and Michelle Knight disappeared between 2002 and 2004 when they were 16, 14 and 20 years old. They escaped in May when Berry kicked out part of a door and called to neighbors for help.

Shane French, the host of the syndicated talk radio show Rover's Morning Glory on WMMS in Cleveland, told The Associated Press in a telephone interview Sunday that he was surprised when Berry showed up at the annual festival. French, who goes by the name Rover on radio, said he had issued an impromptu invitation on his show a few weeks ago but didn't know she was listening.

"I just said that she had 10 years of partying to make up for and she should come," French said.

He said he was surprised when security guards told him Berry had arrived.

French said Berry at first refused to go on stage but then agreed and asked if he would go with her.

"She didn't say why she decided to come, but some of her family members told me they listen to my show every day and had been to RoverFest in the past," French said.

He said a couple of the women with Berry cried, overcome by the crowd's cheers for Berry.

"I didn't see her cry, but I think she was pretty overwhelmed by the response that the crowd gave her," he said of Berry. "She just seemed to be having a great time."

French said he hasn't invited her to appear on his radio show.

"I figured that when she want to tell her story, she'll make the arrangements, and it would have been pointless to even ask," French said.

Castro, 53, who was arrested and jailed shortly after the women escaped, was accused of raping and beating the three repeatedly. He also fathered a 6-year-old daughter with Berry, authorities say.

The women said they were relieved by the conviction and looking forward to the end of the legal proceedings.

Each said she had been kidnapped after accepting a ride from Castro, who had remained friends with DeJesus' family and attended vigils over the years marking her disappearance.

Castro was accused of restraining the women, sometimes chaining them to a pole in a basement, to a bedroom heater or inside a van. The indictment included two counts of aggravated murder related to accusations that he punched and starved one of the women until she miscarried.

Earlier this month, the three women offered thanks on YouTube for emotional and financial backing they've received since going "through hell and back."

JERUSALEM (AP) ? Israel's Cabinet approved the release of 104 long-held Palestinian prisoners Sunday, clearing a hurdle toward a possible resumption of Israeli-Palestinian peace talks after five years of paralysis.

The prisoner release is part of a push by U.S. Secretary of State John Kerry to bring the two sides back to the table. Sunday's 13-7 vote, with two abstentions, marks his first visible achievement after six months of shuttle diplomacy.

As a next step, Israeli and Palestinian negotiators are set to hold preliminary talks in Washington on Tuesday, to be followed by up to nine months of negotiations on a peace deal.

Saeb Erekat, the chief Palestinian negotiator, welcomed the Cabinet vote as "a step toward peace."

The fate of Palestinian prisoners is emotionally charged for both sides. Palestinians tend to view prisoners as heroes who made sacrifices in the struggle for independence. Most Israelis view them as cold-blooded terrorists.

The Cabinet approved the release in principle of the 104 prisoners, said a government official who spoke on condition of anonymity in line with briefing regulations. Under the deal brokered by Kerry, the prisoners would be freed in four stages over several months. Each step would be linked to progress in negotiations.

According to a list provided by the Palestinians, the prisoners have served between 19 and 30 years for involvement in deadly attacks on Israelis. Their release would go a long way toward giving Palestinian President Mahmoud Abbas a popular mandate to resume negotiations with Israel, despite widespread skepticism on both sides after 20 years of intermittent talks that produced no results.

On the Israeli side, Prime Minister Benjamin Netanyahu faced stiff opposition from within his governing coalition, including his own Likud Party. Two Likud ministers and those from the pro-settler Jewish Home Party voted against a prisoner release.

Outside the government complex, hundreds of Israelis who lost loved ones in Palestinian attacks demonstrated against the release.

Netanyahu told the Cabinet releasing prisoners involved in deadly attacks was difficult for him.

"This is not an easy moment for me, and is not easy for the ministers in the government and is especially difficult for the bereaved families," Netanyahu said. "But there are moments where I need to make tough decisions for the good of the country and this is one of those moments."

"I believe that resuming the political process at this time is important for Israel," he said, noting that any peace deal would have to be approved in a national referendum.

Along with the prisoner release, ministers also authorized the resumption of talks with the Palestinians and agreed that a team led by the prime minister would oversee negotiations.

They approved the draft of an amended bill that would require a referendum on any partition deal with the Palestinians.

A resumption of peace talks is not yet assured, though.

Abbas has said he won't go back to talks unless Netanyahu accepts the pre-1967 war lines as a starting line for border talks. That refers to all of the West Bank, Gaza Strip and east Jerusalem. The Palestinians want to establish their state those territories, captured by Israel in 1967, though they have said they are ready for minor adjustments.

Abbas told reporters Friday that the invitation to talks to be issued by Kerry will state that the basis for negotiations is the 1967 line. It's not clear whether Netanyahu has dropped his long-standing objection to the idea.

In his comments Sunday, Erekat referred to the touchy issue.

"I hope that we can use this opportunity that the U.S. has provided for us to resume negotiations, in order to achieve peace with a state of Palestine that can live in peace and security next to the state of Israeli on the 1967 lines," he said.

Before the Cabinet vote, hundreds of relatives of those killed by the prisoners protested the release outside parliament. Families held pictures of slain loved ones and chanted, "Terrorists must not be freed."

One of Netanyahu's major coalition partners, Naftali Bennett of the Jewish Home Party, took part in the rally. "Whoever demands the killers of women and children to be freed are not worthy to be called a partner," he said, referring to Abbas. "We have nothing to negotiate with he who praises the killers of women and children," Bennett said.

Bennett has threatened to pull his party out of the government if the prime minister agrees to other Palestinian demands, such as recognizing the 1967 line as a base for talks.

Other Israeli leaders said freeing the prisoners is a necessary move in order to promote peace talks.

"This is a painful decision ... but it's a step that will strengthen Israel strategically," opposition leader Shelly Yachimovich of the centrist Labor party said. She called on Netanyahu to listen to an Israeli majority in favor of a peace deal and "not to be led by extremists in his government."

A pair of young promising pitchers meet this afternoon when Carlos Torres leads the New York Mets against Taylor Jordan and the Washington Nationals in the finale of a four-game series at Nationals Park.

Torres hasn't lost either of his two starts this season for the Mets. The 20- year-old right-hander will try to follow a solid performance against Atlanta on Tuesday when he limited the Braves to a run over six innings in a 4-1 triumph.

Torres started his time with the Mets this season with 10 consecutive relief efforts, but he was thrown into what is now a six-man rotation so the team can limit the innings pitched by Matt Harvey and Zack Wheeler for the long haul this year. This will mark his first career start against the Nationals.

Jordan has yet to win in five career big league starts. The 24-year-old righty is coming off a 5-1 loss to the Pirates on Tuesday. He allowed nine hits and five runs -- four earned -- over 7 2/3 innings.

Jordan's major league debut came against the Mets at Citi Field on June 29 when he suffered a 5-1 defeat. Jordan yielded five hits and three runs -- one earned -- over 4 1/3 frames.

After losing 11-0 Friday afternoon in the first portion of a doubleheader, the Nationals have held the Mets to a run in each of the last two games, both victories.

On Saturday, Ian Desmond and Denard Span smacked back-to-back home runs in the second to back a solid start from Dan Haren in a 4-1 final.

Bryce Harper added a two-run homer in the third to provide more than run support for Haren (5-11), who held the Mets to one run on three hits while striking out six over seven frames to snap a lengthy 11-start winless skid.

Haren, who hadn't won since May 9, added a double and a run scored in the victory, Washington's third in its last four games.

"It feels great," Haren said of snapping his skid. "It's obviously been a long time to have that winning feeling after a game."

New York starter Dillon Gee (7-8) entered the contest looking to extend his six-start unbeaten streak, but was tagged for four runs on six hits -- including three home runs -- over seven innings to absorb the loss.

"They're a very good team with really good hitters and they're going to make you pay when you make mistakes like that," Gee said of the Nats. "The damage was done early and there's nothing I can do about it."

David Wright recorded two of New York's four hits and knocked in the lone run.

Washington leads the season series, 6-5.

New lake at North Pole? More of a pond, really

Is the buzz warranted over a new "lake" at the North Pole thanks to global warming? Mostly no. But the Arctic ice is melting.

The online buzz over a new "lake" on the North Pole as the latest symbol of global warming is mostly hype.

Yes, there is a new foot-deep body of water in the Arctic. But this isn't unusual. This is another Arctic pond caused by seasonal (summer) warming. And the camera lens distorts the size.

"I have seen much more extensive ponding," James Morison, the principal investigator for the North Pole Environmental Observatory told The Atlantic. "Because we use wide angle lenses the melt pond looks much bigger than it is."

Note the use of the word "pond" to describe this body of water.

The Atlantic goes on to note that last summer's Arctic ice melt was one of the worst, and this year's hasn't been as bad, so far. The now-famous pond was the result of an early July heat wave.

"While the rate of Arctic sea ice loss is normally fastest during July, the warmest month of the year, ice loss was even faster than usual over the first two weeks of July 2013," according to the National Snow and Ice Data Center. "Compared to the 1981 to 2010 average, ice extent on July 15, 2013 was 1.06 million square kilometers (409,000 square miles) below average."

Still, global warming is taking a toll on the Arctic, say most scientists. As the National Oceanic and Atmosphere Administration 2012 Arctic Report Card states: "Large changes in multiple indicators are affecting climate and ecosystems, and, combined, these changes provide strong evidence of the momentum that has developed in the Arctic environmental system due to the impacts of a persistent warming trend that began over 30 years ago."

And as The Christian Science Monitor noted this week, it's not the creation of Arctic ponds that's worrying ? it's the release of methane gas. The release of Arctic methane gas due to warming trends is an "economic time bomb," which could cost the world $60 trillion. Yes, that's trillion ? the equivalent of the world's entire economic output in 2012.

"The Arctic ice stores roughly 50 billion tons of methane, a concentrated gas some 20 times more powerful than carbon dioxide. Over the past few years, scientists have observed the gas pluming from the region?s thawing ice. That raised the question: even as profits are hauled in from shipping and drilling in the Arctic, could that methane gas be waiting to undo all those gains? Could the toll of that released gas far outweigh the rewards of melting Arctic?s ice?"

Obama says narrowed Fed choices, to announce in months: NY Times

WASHINGTON (Reuters) - President Barack Obama has narrowed his choices to succeed Federal Reserve Chairman Ben Bernanke to "some extraordinary candidates" and will announce his pick "over the next several months," he said in an interview with the New York Times.

In the interview, released on Saturday, Obama said he wanted a Fed leader who would focus on helping the economy grow and not just work abstractly to keep inflation in check and markets stable, the Times reported.

"The idea is to promote those things in service of the lives of ordinary Americans getting better," Obama said. "I want a Fed chairman that can step back and look at that objectively and say, 'Let's make sure that we're growing the economy,'" he said.

Former U.S. Treasury Secretary Lawrence Summers and Fed Vice Chair Janet Yellen are thought to be the two top candidates for the job.

Senior White House officials said earlier this week Obama had made no decision about who to nominate to replace Bernanke when his term expires on January 31. Bernanke, who has led the Fed since 2006, is widely believed not to want to stay on for a third four-year term.

The central bank plays a key role in guiding the world's largest economy and has taken on new financial oversight responsibilities following the worst U.S. financial crisis since the Great Depression.

Summers is a former economic adviser to Obama. Yellen is a former Clinton administration official; she would be the first woman to lead the Fed.

Wis. man, 76, guilty in fatal shooting of teen

MILWAUKEE (AP) ? A Milwaukee man who suspected his 13-year-old neighbor of breaking into his home and stealing weapons was convicted Wednesday of fatally shooting the boy as the teen's mother looked on. Now, jurors will decide whether the 76-year-old defendant was mentally ill at the time.

A jury deliberated for about an hour before finding John Henry Spooner guilty of first-degree intentional homicide. Surveillance video from his own security cameras showed him confronting Darius Simmons in May 2012, pointing a gun at him from about 6 feet away and shooting him in the chest.

Spooner had entered two pleas to the homicide charge: not guilty and not guilty by reason of mental disease or defect. That set up the trial to be conducted in two phases: the first to determine whether he was guilty of the homicide, and if so, a second to determine whether he was mentally competent at the time.

With the first phase complete, the second began with testimony from a psychiatrist hired by the defense. Dr. Basil Jackson said his examination of Spooner revealed a man with anger issues who periodically dissociated from reality.

Spooner's daughter once brought home a kitten that he didn't want so he took it into the basement and killed it, Jackson said. Spooner also used to choke and beat his late wife, the doctor testified.

The violence shows Spooner occasionally loses the ability to control his anger ? as during the moments that he shot Darius, Jackson said.

"There was an eruption, a loss of control. And at that moment he was not able ? at that moment ? to make a judgment," Jackson said. "It's like he was on autopilot."

Spooner's defense attorney, Franklyn Gimbel, never denied that his client shot Darius. Instead, he argued that Spooner did not mean for the gunshot to be fatal.

"This is not a case of whodunit," Gimbel said. "It's not a question of whether the behaviors of John Spooner caused the death of the young man ? but what motivated it and what went on in his mind at the time is the crucial question."

During the second phase of the trial, the burden of proof shifts to the defense, which only has to prove "clear and convincing evidence," instead of the stricter standard of "beyond a reasonable doubt." In addition, a verdict requires agreement from only 10 jurors, not unanimity from all 12.

Spooner's surveillance video provides a clear view of what happened. Spooner emerges from his house and confronts the teen, who is retrieving his family's garbage cart from the street. Spooner points a gun at Darius, who moves back a few steps. Spooner then exchanges words with Darius' mother, who's standing on her porch out of view of the camera, and Spooner briefly points the gun in her direction. Moments later, Spooner points the gun back at the boy standing a couple of feet in front of him. He fires, hitting Darius in the chest.

The teen stumbles and runs away, and Spooner fires a second shot that misses. He appears to attempt a third shot, but the gun jams.

Darius' mother, Patricia Larry, testified that she chased her son to where he collapsed in the street. She cradled him in her arms as he died.

"I pulled his shirt up and I (saw) he had a bullet hole in his chest," she said tearfully. "He took one more breath and that's it."

Spooner paced along the sidewalk until police arrived a few minutes later. Police officer Richard Martinez testified that he was handcuffing Spooner when Spooner acknowledged, "Yeah, I shot him."

During closing arguments, Gimbel seized upon that statement as an indication that his client didn't mean to fire a fatal shot.

"He didn't say, 'I killed the kid.' He didn't try to explain anything about the circumstances," Gimbel said.

But prosecutor Mark Williams said it's impossible to watch the video without realizing that Spooner knew exactly what he was doing. He pointed out that Spooner confronted Darius, aimed deliberately and pulled the trigger.

"How is that not intent to kill?" he asked. "You can see the intent. Look at him (Darius) holding his chest. Look how close they are together. It's point-blank range. Darius runs away and he shoots again."

Larry's attorney, Jonathan Safran, said the family was pleased with the verdict. "She's cautiously optimistic as we move into this second phase of the trial," he said.

Nielsen: Tech ad spend soared in Q1 with Microsoft in the lead

Analysts at various market intelligence firms seem to be pointing toward a petite tech boom this week. Following up a report from CB Insights about improving IPOs, Nielsen is chiming in with positive figures for technology ad spend.

To clarify, the figures refer to how much technology companies dished out to advertise their own products, or as Nielsen reps put it, "the never-ending battle to gain market share and stand out as the 'it' gadget of our time."

Nielsen found that domestic tech ad spend climbed to $723 million during the first quarter of 2013 -- a 30 percent increase annually.

The report also highlights how significant this is when ad spend was actually down by approximately one percent across all other verticals.

Analysts reflected that this surge is due in part to more aggressive tactics being employed to convince consumers that they (and they alone) offer the fastest and smartest devices on the market.

The technology industry hasn?t seen a first-quarter jump of this magnitude in several years?especially not when advertisers are exercising restraint in most other industries. But it speaks to a larger, recent trend of consumers? willingness to adopt new technology, and advertisers are making sure they don?t miss an opportunity to connect with potential customers.

Turns out the leader in tech ad spend during Q1 was Microsoft, which was firing on all fronts trying to push Windows 8, Windows Phone, and the Surface tablet.

With a whopping 200 percent increase in ad spend year-over-year, Microsoft knocked Intuit out of the top spot for the first time in five years.

That might seem like an unusual match-up, but when you consider that the first quarter is dominated by the tax season -- Intuit's prime time ahead of April 15 -- then it goes to show how aggressive Microsoft must have been in its advertising and marketing efforts.

Texas, libraries work against childhood obesity

AUSTIN, Texas (AP) ? Hundreds of public libraries and schools across Texas are eligible to receive nutrition and fitness-related books and DVDs to help fight childhood obesity.

Comptroller Susan Combs on Tuesday announced a partnership with the Texas Library Association. Combs says officials seek to raise awareness and understanding about the importance of healthy habits throughout life.

The state's 910 public libraries and more than 1,100 select public elementary schools are in line to get nutrition and fitness-related books and other educational materials. The items will be distributed starting next month.

The comptroller's office will also supply free sports equipment to public schools in areas considered high risk for obesity.

Legislators have required the comptroller's office to compile research and information on the economic effects of obesity and areas where children are at risk.

Ohio Nat'l Guardsman Charged with Child Sex Abuse in Union County

Updated: Tuesday, July 16 2013, 12:07 AM EDT

UNION COUNTY (Ken Hines) -- An Ohio National Guard member currently stationed in Kuwait faces more than a dozen charges related to the alleged sexual abuse of children.

Jean Paul Kruse was indicted on five counts of rape and sexual battery, along with several additional charges, as part of an investigation that began in August 2012 after Union Co. Jobs and Family Services officials attempted to remove Kruse's 11 children from the family's home.

Investigators said Kruse abused 3 children between the ages of 5 and 12 during a 6-year-period beginning in 2006.

Kruse is also charged -- along with his wife, Emily -- with intimidating an attorney, victim, or witness. Emily Kruse faces an additional count of obstruction of justice.

Both are scheduled to be arraigned August 1.

Sony agrees to pay ?250K fine in UK for 2011 data breach, begrudgingly

Remember the 2011 attack that crippled Sony's PlayStation Network, leaked almost a quarter million users' information and generally was a nuisance? It's still cleaning up after that mess. Earlier this year, the UK's Information Commissioner's Office (ICO) slapped the company's European wing with a £250,000 fine ($377,575), saying it should have been better prepared for the attack -- now Sony's agreed to pay up. The electronics giant still maintains that the charge is without merit, but ceded to the penalty to avoid disclosing details about its security procedures. Apparently, the two months of free PS+ wasn't enough to make everybody forget.
